# Terms of Service

Welcome to Tremors. These Terms of Service ("**Terms**") form a binding agreement between you and Little Wolf ("**we**," "**us**," or "**our**") and govern your access to and use of the Tremors application for Apple Watch (the "**App**") and any related websites, content, and services (together, the "**Service**").
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

## 1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

## 2. About the App
Tremors plays customizable, randomized haptic patterns on your Apple Watch. The App is intended for general personal comfort and wellness use only.
Tremors is not a medical device. It is not designed, intended, or approved to diagnose, treat, cure, prevent, or mitigate any disease, disorder, or medical condition, including Parkinson's disease, essential tremor, or any other movement disorder. It is not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of a qualified healthcare provider with any questions you have about a medical condition, and never disregard or delay seeking professional medical advice because of something you experienced while using Tremors. In a medical emergency, call your local emergency number immediately.

## 3. Subscription, free trial, billing, and cancellation
Tremors is offered as an auto-renewable subscription with an introductory free trial.
- Free trial. Eligible new subscribers receive a 14-day free trial. You can cancel any time during the trial period to avoid being charged.
- Subscription price. After the free trial, the subscription is $1.99 USD per month (or the equivalent in your local currency as set by Apple's App Store pricing tiers).
- Automatic renewal. Your subscription automatically renews each month for the same price until you cancel. Payment is charged to your Apple ID at confirmation of purchase and again at the start of each renewal period.
- How to cancel. You can cancel any time, at least 24 hours before the end of the current billing period, from your iPhone's Settings → [Your Name] → Subscriptions, or directly from the App Store. Cancellations take effect at the end of the current billing period; you will continue to have access to the App until then.
- Refunds. All purchases are processed by Apple. Refund requests are governed by Apple's policies and can be submitted at https://reportaproblem.apple.com. We do not directly process payments or refunds.
- Price changes. We may change the subscription price from time to time. Where required, Apple will notify you of the new price before it takes effect and give you an opportunity to consent to the change. If you do not consent, your subscription will not renew at the new price.

## 4. License grant
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple Watch devices that you own or control, solely for your personal, non-commercial use. All rights not expressly granted to you are reserved by us and our licensors.
Your use of the App is also subject to the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/) and any other terms imposed by Apple.

## 5. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent permitted by applicable law;
- Copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App or any part of the Service;
- Use the Service in any unlawful manner, for any unlawful purpose, or in a way that infringes the rights of others;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, our servers, or any networks connected to the Service;
- Use the Service to transmit malware, viruses, or any other harmful content;
- Use any automated means (including bots, scrapers, or crawlers) to access the Service.

## 6. Intellectual property
The Service, including the App, its source code, design, graphics, user interface, content, "Tremors" name, logos, and all related trademarks, is owned by Little Wolf or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms transfers any ownership of our intellectual property to you, and nothing grants you any right to use any of our names, logos, or trademarks without our prior written consent.

Your use of the Service is also governed by our Privacy Policy, available at littlewolf.app/privacy-policy which is incorporated into these Terms by reference. Please review it carefully to understand how we handle your information.

## 8. Third-party services
The App is distributed through the Apple App Store and uses Apple's StoreKit framework for purchases. Your relationship with Apple is governed by Apple's own terms. We are not responsible for the availability, content, products, services, terms, or practices of Apple or any other third party.

## 9. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.
WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND ABOUT THE THERAPEUTIC, HEALTH, OR MEDICAL EFFECTS OF THE APP. ANY RELIANCE YOU PLACE ON THE SERVICE IS AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

## 10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITTLE WOLF, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $20.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

## 11. Indemnification
You agree to indemnify, defend, and hold harmless Little Wolf and our officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

## 12. Termination
You may stop using the Service at any time by uninstalling the App and cancelling your subscription as described in Section 3.
We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if we discontinue the Service. Upon termination, the rights granted to you under these Terms will end, and the sections that by their nature should survive (including Sections 6, 7, 9, 10, 11, 13, and 14) will survive.

## 13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting an updated version with a new "Effective date" at the top of this page and, where appropriate, by notice within the App. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, please stop using the Service.

## 14. Governing law and dispute resolution
These Terms are governed by the laws of Maryland, USA without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Baltimore County, Maryland, and you and we consent to the personal jurisdiction of those courts, except where prohibited by applicable law. Nothing in this section limits your statutory consumer rights in your country of residence.

## 15. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced, are the entire agreement between you and us regarding the Service and supersede all prior agreements on the subject.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without restriction.
- Headings. Section headings are for convenience only and have no legal effect.
